Judge Orders Trump to Return California National Guard Control

A federal judge has issued a temporary restraining order directing President Trump to return control of the California National Guard by Friday noon. This rare legal rebuke highlights a showdown over federal power and state sovereignty.

In his order, U.S. District Judge Charles Breyer declared that deploying roughly 4,000 National Guard members and U.S. Marines to Los Angeles violated the Tenth Amendment and exceeded the president’s statutory authority. The troops were sent to support immigration raids amid growing protests over the federal crackdown.

California Governor Gavin Newsom sued to block the deployment, arguing it was made against his wishes and without proper legal basis. Newsom’s emergency motion sought to bar military units from assisting with immigration enforcement.

During a hearing in San Francisco, the Justice Department contended that courts lack jurisdiction to question presidential decisions on troop deployments. Judge Breyer expressed skepticism that Trump complied with the law governing federalization of state units but delayed enforcement to allow for appeals and scheduled a June 20 hearing to consider permanent restrictions.

As the Trump administration takes its appeal to the Ninth Circuit, the case shines a spotlight on the constitutional limits of executive power and the role of state governors in commanding their National Guard forces.
