China Enhances Legal Safeguards for Private Enterprises

The Supreme People's Court (SPC) of China has announced a commitment to strengthen the law-based protection of property and personality rights for private enterprises and entrepreneurs. In a recent statement, the SPC emphasized the implementation of effective measures to prevent administrative and criminal interference in economic disputes, aiming to minimize the negative impact of lawsuits on business operations and production.

The SPC has urged people's courts at all levels to address the pressing concerns of private enterprises, with a special focus on micro, small, and medium-sized enterprises (SMEs). This initiative seeks to create a more favorable judicial environment that supports the growth and sustainability of businesses across the country.

In addition to reducing legal impediments, the top court has pledged to combat the abuse of power and promote fair and reasonable judicial protection. Strengthening the protection of science and technology innovation is also a key priority, ensuring that innovative enterprises can thrive without undue legal challenges.

According to SPC data, approximately 1.27 million commercial cases of first instance were settled in the first half of this year, marking a 13.5 percent decrease compared to the same period last year. This decline reflects the ongoing efforts to streamline judicial processes and reduce the burden on businesses.

Further reinforcing these initiatives, China plans to improve its property rights system to ensure equitable protection for all forms of economic entities. The country is also set to bolster law enforcement and justice administration to safeguard property rights and prevent administrative and criminal interference in economic disputes. These measures are part of a broader resolution on deepening reforms to advance Chinese modernization, recently adopted by the 20th Central Committee of the Communist Party of China.
